Welcome to How You Create. These Terms and Conditions ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms.

1. Services Overview

How You Create provides website design, branding, and digital marketing services for local businesses. Our services include but are not limited to:

  • Website design and development
  • Logo design and branding
  • Social media account setup
  • Content creation (blog posts and social media content)
  • Website hosting and domain registration
  • Ongoing website maintenance and support

2. Service Packages

We offer three main service packages:

  • Starter ($499): Professional 5-page website with 1 year hosting and domain included
  • Professional ($799): Logo, branding, and professional website
  • Premium ($1,499): Complete digital presence including logo, branding, website, social media setup, and content creation

Package details and pricing are subject to change. The price quoted at the time of your order will be honored.

3. Preview and Approval Process

Before payment is required, we provide a free preview of your website design. This allows you to:

  • See the design before committing
  • Request revisions to the design
  • Approve or decline the project

Once you approve the design and make payment, we will proceed with launching your website. Any major changes requested after approval and payment may incur additional charges.

4. Payment Terms

4.1 Payment Processing

All payments are processed securely through Stripe. We accept major credit cards including Visa, Mastercard, American Express, and Discover. By providing payment information, you represent that you are authorized to use the payment method.

4.2 Pricing

All prices are quoted in US dollars and are exclusive of any applicable taxes. The total amount due will be clearly displayed before you complete your purchase.

4.3 Hosting and Domain Renewal

The first year of hosting ($49 value) and domain registration ($15 value) are included in all packages. After the first year:

  • Hosting renewal: $49/year
  • Domain renewal: $15/year

You will be notified before any renewal charges are processed. You may choose not to renew, in which case your website will be taken offline.

5. Intellectual Property

5.1 Your Content

You retain all rights to your business name, logo (if you provided one), photos, and written content that you supply to us. You grant us a license to use this content for the purpose of creating and maintaining your website.

5.2 Our Work

Upon full payment, you own the custom design and content we create for you, including:

  • Custom website design
  • Logo design (Professional and Premium packages)
  • Written content created for your website
  • Custom graphics and images

5.3 Third-Party Assets

Stock images, fonts, and other third-party assets used in your website are licensed, not owned. These licenses permit use on your website but may have restrictions on other uses. We will inform you of any limitations.

5.4 Portfolio Rights

We reserve the right to display your website in our portfolio and marketing materials unless you specifically request otherwise in writing.

6. Your Responsibilities

You agree to:

  • Provide accurate and complete information about your business
  • Respond to our requests for information and feedback in a timely manner
  • Review and approve designs within a reasonable timeframe
  • Ensure you have the right to use any content you provide to us
  • Not use our services for any illegal or unauthorized purpose
  • Keep your account credentials confidential

7. Project Timeline

Typical project timelines are:

  • Starter: 5-7 business days
  • Professional: 7-10 business days
  • Premium: 10-14 business days

These timelines assume timely responses and approvals from you. Delays in providing information or feedback may extend the timeline.

8. Revisions

We offer unlimited revisions during the design phase until you are satisfied. "Revisions" means adjustments to the existing design, such as:

  • Color changes
  • Font adjustments
  • Layout modifications
  • Content updates
  • Image changes

A complete redesign or significant scope changes may require additional fees, which will be quoted before work begins.

9. Website Hosting

Our hosting service includes:

  • 99.9% uptime guarantee
  • Daily backups
  • SSL certificate
  • Security monitoring
  • Technical support

We reserve the right to suspend or terminate hosting services if you violate these Terms or engage in activities that harm our servers or other customers.

10. Support and Maintenance

After launch, we provide:

  • Starter and Professional: 30 days of free support
  • Premium: 30 days of dedicated support with a dedicated account manager

After the initial support period, we offer ongoing maintenance services at competitive rates. Small updates and fixes are typically free; larger changes are billed at $50/hour.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability is limited to the amount you paid for our services
  • We are not responsible for any loss of business, revenue, or data
  • We do not guarantee specific results such as increased traffic or sales

12. Indemnification

You agree to indemnify and hold How You Create harmless from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you provide that infringes on intellectual property rights

13. Termination

Either party may terminate the agreement:

  • Before payment: Either party may cancel at any time without penalty
  • After payment: See our Refund Policy for details
  • For cause: We may terminate immediately if you violate these Terms

Upon termination, we will provide you with your website files upon request.

14. Governing Law

These Terms are governed by the laws of the State of Georgia, United States. Any disputes will be resolved in the courts of Georgia.

15. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes by posting the new Terms on our website. Your continued use of our services after changes constitutes acceptance of the new Terms.
